1. Agreement to Terms

By accessing or using Own Your Category ("the Service"), operated by Gold Front ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Own Your Category is an AI-powered platform that provides access to AI assistant tools ("Tools") for content creation, strategy, and business support. The Tools use third-party AI models to generate responses based on your input.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account.

4. Subscription Plans and Payment

The Service offers subscription plans with different usage limits. By subscribing to a paid plan, you agree to pay the fees associated with your selected plan. Payments are processed through Stripe. All fees are non-refundable unless otherwise stated or required by applicable law.

We reserve the right to change pricing with 30 days' notice to active subscribers.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Generate content that is harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service to generate spam, phishing content, or malware
• Reverse-engineer, decompile, or otherwise attempt to extract the source code of the Service
• Exceed your plan's usage limits through automated means
• Share your account credentials with others
• Use the Tools to generate content that impersonates real individuals without consent

6. AI-Generated Content

The Tools generate content using AI models. You acknowledge that:

• AI-generated content may not always be accurate, complete, or appropriate
• You are responsible for reviewing and editing all AI-generated content before use
• We do not guarantee the accuracy, quality, or suitability of AI-generated content
• AI-generated content should not be relied upon for legal, medical, financial, or other professional advice

7. Intellectual Property

• Your Content: You retain ownership of all content you input into the Service and all AI-generated outputs based on your inputs.
• Our Service: The Service, including its design, code, and branding, is owned by us and protected by intellectual property laws.
• AI Models: The AI models powering the Tools are provided by third parties (Anthropic) under their own terms and licenses.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, available at /privacy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any content generated by the AI Tools
• Unauthorized access to or alteration of your account
• Any third-party conduct on the Service

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through the billing portal. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as described in our Privacy Policy.

12. Changes to Terms

We may update these Terms at any time. We will notify active users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in the State of California, United States, and you consent to the personal jurisdiction of those courts.
